Heritage Communities Privacy Policy

1. Introduction

Thank you for visiting Heritage Communities! You have arrived at the online service location (e.g. the web site (the “Site”)) heritage-communities.com, which is owned and operated by Heritage Holdings L.P. and Heritage Management Services, Inc. (collectively, the “Company”, “Heritage”, or “we”). The Company may share information among its affiliates, subsidiaries, or sites that it owns or controls in accordance with the practices set forth in this Privacy Policy (the “Policy”) This Policy governs your use of the Site and any online service location, including a mobile application, that posts a link to this Policy. This Policy also applies to your use of interactive features, chat boxes, widgets, plug-ins, applications, content, downloads and other services (collectively, the “Service”) that the Company owns or controls and makes available through an online service or wherever Company posts a link to this Policy, regardless of how you access or use the Service, whether via personal computers, mobile devices or electronic media. This Policy applies to how we collect and use all personal and non-personal information received by the Company whether in electronic, written or verbal format. This Policy, together with our Terms of Use (found here), govern your use of this Site.

To the extent we provide you with additional privacy policies or practices (e.g., at the point of our collection), those additional terms shall govern such data collection and use.

By using our Site, you consent to this Policy and our collection, use and sharing of your information and data, and other activities, as described herein. If you do not agree, please exit the Service and the Site immediately.

The Company reserves the right to modify this Policy at any time and will do so from time to time. Each modification shall be effective upon its posting to the Site. Your continued use of the Site following any such modification constitutes your acceptance of any changes to this Policy.

PLEASE NOTE THAT THIS POLICY DOES NOT APPLY TO PROTECTED HEALTH INFORMATION (“PHI”). Only when you become a resident of Heritage Communities and complete a health needs assessment, will we receive your PHI. PHI is treated in accordance with our Notice of Privacy Practices provided to residents upon move in.

2. Information Company Collects About You

The Site automatically captures your domain name, the IP address of the web page from which you enter the Service, browser type, the pages you visit on the Service, the amount of time you spend here and other relevant information about your visit. We do not collect any information that can reveal your personal identity unless you voluntarily provide it when you register to use interactive features of the Service, request information about the Company’s services, schedule a tour of our communities or call us. If you use the features on the Service, you are “opting in” and agree to our collection of information as described above. You may “opt out” of our collection of information. If you “opt out,” you cannot use the interactive features. Any time you visit or access the Service, you receive a “cookie” from the Company. The Company uses cookies (small pieces of data stored for an extended period on a computer, mobile phone, or other device) to make the Service easier to use. Read more about Cookies, below.

3. Information You Provide to the Company

You can generally visit our Site without revealing any personally identifiable information about yourself. However, in certain sections of this Site, we may require you to submit your personally identifiable information to us and we may invite you to submit questions, comments and request information.

Due to the nature of some of our services, you may provide us with personally identifiable information such as your name, email address, username, password, address, phone number, and other contact information that you voluntarily transmit with your communication to us.

4. How the Company Uses and Shares Your Personal Information

We will only share your personal information with third parties as permitted by this Privacy Policy (in its current or future form) and as otherwise required by law.

We may use your personally identifiable information to deliver our services or information you have requested, verify your authority to enter certain password protected areas of the Site, verify that you are a customer or prospective customer, send you information that you have signed up to receive, notices about our products and/or services that you have used or that may be of interest to you and notices about events, and improve the content and general administration of the Site, the Service and our services. We track the total number of visitors to the Site, the number of visitors to each page of our Site, browser type, IP addresses, External Web Sites (defined below) linked to and other aggregated data collected through our services and we may analyze this data for trends and statistics in the aggregate but such information will be maintained, used and disclosed in aggregate form only and it will not contain personally identifiable information. We may use such aggregate information to analyze trends, administer the Service, track users’ movement, and gather broad demographic information for aggregate use.

If you are a user of our services, we may use your personally identifiable information to provide the services to you.

We may provide your personally identifiable information and the data generated by cookies and third-party analytics tools and the aggregate information to the vendors and service agencies that we may engage to assist us in providing our services to you.

We may disclose your personally identifiable information as required by law, regulation or other government authority or to assist in any investigation, to protect our or our users’ rights or to enforce our Terms of Use.

We may share personal information if all or part of the Company is sold, merged, dissolved, acquired, or in a similar transaction.

We will not sell your personally identifiable information to any company or organization.

We may share and give access to personal information to our employees and agents in the course of operating our business. For example, if you sent us an e-mail asking a question, we would provide your e-mail address to one of our employees or agents, along with your question, for that person to reply to your e-mail. We may share personal information with other Heritage subsidiaries or affiliates.

We also may share and give access to personal information with other companies that we hire or collaborate with to perform services or functions on our behalf. For example, we may hire an outside company to help us send and manage e-mail, and in that case, we might provide the outside company with your e-mail address and certain other information in order for them to send you an e-mail message on our behalf. Similarly, we may hire outside companies to host or operate some of our websites and related computers.

However, if we share or give access to information to outside companies, we require them to use the personal information only for limited purposes, such as for sending you the e-mail in the example above. If you believe we or any company associated with Heritage has misused any of your information, please contact us immediately and report such misuse.

We may share personal information in response to a court order, subpoena, search warrant, law or regulation. We may cooperate with law enforcement authorities in investigating and prosecuting website visitors who violate our rules or engage in behavior that is harmful to other visitors or is illegal.

5. Children’s Privacy

We recognize the privacy interests of children and encourage parents and guardians to take an active role in their children’s online activities and interests. Neither our Site nor our services are intended for children under the age of 13. We do not knowingly target, solicit or collect personal data from children under the age of 13. If we discover that we have unintentionally collected personal data from a child below the age of 13, we will remove that child’s personal data promptly from our records.

We also do not knowingly solicit or collect personal data from children under the age of 18 for the specific purposes of marketing communications.

6. Cookies

When you visit the Site, we use both session ID cookies and persistent cookies. A session ID cookie expires when you leave the Site and close your browser. A persistent cookie remains on your hard drive for an extended period. These cookies give the Company information about your use of the Service. You may remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use the Service. Company may also use pixels, widgets, and other tools to gather such information to improve the experience of the Site. When you access the Service from a computer, mobile phone, or other device, the Company may collect information from that device about your browser type, location, and IP address, as well as the pages you visit.

On our Site, we use session cookies to make it easier for you to navigate the Site by remembering your locale preferences and to improve and track the overall Site experience. For our Site, we set a persistent cookie to authenticate your login and authorization to use the services. Persistent cookies enable us to track, store and target the interests of our users to enhance the experience on our Site. If you reject cookies, you may still use our Site, but your ability to use some areas of our Site may be limited, as refusing cookies disables our ability to include information about your visit in our regular monitoring of Site traffic.

7. Third Party Analytics Tools

In addition to the personally identifiable information, you voluntarily provide to us, the Company utilizes analytics tools including third party technologies, including Google Analytics, to collect non-personally identifiable information utilizing cookies. Certain types of information, including geolocation, device type, onsite website usage and behavior, demographic data, and purchase history, is collected and aggregated across the Site users for our analysis and advertising efforts.

The Company uses Remarketing with Google Analytics and Google Adwords to display relevant advertisements to users who have previously visited our Site. Referred to as remarketing or retargeting, the Company may utilize previous session information to serve display advertisements to you on the Site and based on such session information Google may set a cookie and serve ads to you on third party websites on the Google Display Network. Third party vendors such as Google may display Company ads on websites across the Internet. Aggregated user data may be utilized to create remarketing/retargeting “lists,” or groups of users with similar onsite behaviors or demographics.

The Company also uses Google Display Network Impression Reporting and Google Analytics Demographics and Interest Reporting and Interest-Based Advertising to display advertisements to users based on their inferred interests and demographics. The Company does not run interest-based advertising campaigns that collect personally identifiable information.

Users may learn more about Google Analytics use of cookies by visiting the Google Privacy and Terms page at https://policies.google.com/. You can opt-out of having your site activity available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (gtag.js, analytics.js) that is running on websites from sharing information with Google Analytics about visit activity. Using the Google Analytics opt-out browser add-on will not prevent site owners from using other tools to measure site analytics. It does not prevent data from being sent to the website itself or in other ways to web analytics services.

This website may use third-party analytics tool, to track page content and click/touch, movement, scroll, and keystroke activity.

8. Links to Third Party Sites

The Site may provide links to other Web sites or resources over which Heritage does not have control (“External Web Sites”). Such links do not constitute an endorsement by Heritage of those External Web Sites. You acknowledge that Heritage is providing these links to you only as a convenience, and further agree that Heritage is not responsible for the content of such External Web Sites. Your use of External Web Sites is subject to the terms of use and privacy policies located on the linked to External Web Sites.

9. Security

We employ industry standard procedural and technological measures that are reasonably designed to help protect your personally identifiable information from loss, unauthorized access, disclosure, alteration or destruction. We may use, without limitation, firewalls, password protection, secure socket layer, and other security measures to help prevent unauthorized access to your personally identifiable information.

10. Notice to European Users

This Site and the Service are targeted for users in the United States of America. Any information you enter on this Site may be transferred outside of the European Union to the United States of America which does not offer an equivalent level of protection to that required in the European Union. In particular, you are advised that the United States of America uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. Article 26 of the European Union’s Data Protection Directive (Directive 95/46/EC, 1995 O.J. (L 281) 31) allows for transfer of personal data from the European Union to a third country if the individual has unambiguously given his consent to the transfer of personal information, regardless of the third country’s level of protection. By using this Site or the services, you consent to the transfer of all such information to the United States of America which may not offer an equivalent level of protection to that required in the European Union and to the processing of that information by Heritage on its servers located in the United States of America as described in this Policy.
